Insurance agents
countryProblems that should be paid attention to when handling cargo insurance claims

1. Apply for claims. Claims for import and export cargo insurance can be divided into two situations:

1. the loss of the international freight export goods, the other party (importer) claims the foreign claims agent specified in the insurance policy. In all the major ports and cities in the world, the People's Insurance Company of China has two agencies, entrusting foreign inspection agents and claim agents. The former is responsible for the inspection of the loss of goods. After the consignee has obtained the inspection report, the consignee is attached to the other documents and claims to the single company on its own. The latter can directly deal with the claim case within a certain amount of authorization and pay the indemnity in place.

When importing cargo insurance claims to foreign claims agents, the international freight importers should also provide the following documents:

(1) the insurance certificate or the original of the insurance certificate;
(2) transport contract;
(3) invoices;
(4) packing list;
(5) a letter or other document requesting compensation from the three party responsible for the carrier, as well as documents that prove that the insured has fulfilled the procedures to be recovered.
(6) the inspection report issued by a foreign insurance agent or by a notary agency of third foreign countries;
(7) Maritime report. The loss caused by maritime goods is generally covered by the insurance company, and the ship is not liable.
(8) proof of cargo damage;
(9) the list of claims; and so on.
2. the loss of imported goods from the international freight industry, China's import direction insurance company to import and export cargo insurance claims application. When the import goods are shipped to our port, the airport or the mainland, the local insurance company should be informed immediately and the inspection department of the local state shall jointly carry out the inspection. If a loss is determined within the scope of the insurance liability, a report on the inspection of remnant short of the imported goods shall be issued by the local insurance company. At the same time, the liability of the cargo damage caused by the foreign consignor, the carrier, the port authority, the railway or the other third parties shall be paid by the insurance company as long as the consignee handles the procedure of recourse to the above responsible party. However, according to the provisions of the insurance company, the insurance company is not responsible for the liability for the quality and specification liability of the foreign consignor. The consignee should ask the consignee to issue a Notary Inspection book by the State commodity inspection agency, and then make a claim by the consignee to the consignor through the foreign trade company.

When the consignee lodged a claim with the insurance company, the following documents should be submitted:

(1) import invoices;
(2) Bill of lading or notice of import and export cargo and waybill;
(3) discharge record and pound code list at the final destination.
If loss is involved in the shipper's liability, an order contract must be provided. If there is a consignor's letter of guarantee and a ship's endorsement, it should also be provided. If the loss involves the ship's liability, a cargo port visa must be provided. If there is a ship's approval, it is also provided. Where the shipper or ship's liability is involved, the State commodity inspection department must be identified. If loss is involved in port loading and unloading and inland transportation, inland river or railway transport operator's responsibility, we must provide freight records (business records) and joint inspection reports issued by the responsible party.
The consignee handles the claim for import and export cargo insurance to the insurance company, which can be carried out in the following ways: loss of goods imported by sea, claim to the unload port insurance company, loss of imported goods by air cargo, claim to the destination insurance company marked on the international transport bill, loss of imported goods of post shipment, indicating to International Parcel List Claim from the destination insurance company; the loss of the imported goods on land, and the claim to the destination insurance company marked on the international railway waybill.

Two. Check the responsibility and pay the compensation. The insured can wait for the insurance company to verify the liability and pay the compensation after completing the above claim procedures and providing complete documents. In our country, there are two kinds of indemnity ways for insurance companies:

One is to pay directly to the receiving unit;
The two is to centrally compensate the relevant foreign trade companies, and then settle them by foreign trade companies and ordering units.
